State Insurance Requirements

All registered or operated vehicles must be covered by liability insurance. The Minimum amount of liability coverage required by the state of West Virginia is $20,000 for injury, $40,000 for all injuries, and $10,000 in property damage. Commonly referred to as 20/40/10 coverage.

You are required to carry proof of insurance in your vehicle.

The list below constitute legal proof of insurance:

  • A temporary insurance card issued by the insurer
  • Permanent Insurance Card
  • Policy Declaration Page
  • The actual liability insurance policy issued for the vehicle
  • A certificate of liability insurance policy issued by either the insurer or an authorized agent
  • A copy of the rental agreement when renting a motor vehicle which specifies the insurance coverage
If you fail to show proof of insurance, the registration of your vehicle will be suspended. The reinstatement fee is $100, plus proof of insurance. If the division sends a state police secure order on the plate, an additional fee of $50 will be assessed.
DMV Point System

This state enlists a point system to monitor and penalize driving infractions. If a driver is convicted of traffic law violations, the driver will gain points on their drivers license. If those points reach a state specified amount, their license will be suspended for a predetermined period based on the amount of points gained.

Below is a list of violations and their corresponding point values:

8 Points:

  • Fleeing a police officer 

6 Points:

  • Hit and Run/Leaving the Scene
  • Speeding in a school zone
  • Reckless driving 

5 Points: 

  • Speeding 15 mph or more above posted limit

3 Points:

  • All Lane violations
  • Speeding 10 to 14 m.p.h. above posted limit
  • Driving wrong way on a one-way street
  • Driving too fast for conditions
  • All varieties of failure to yield
  • Failure to maintain control/use due care
  • Failure to obey traffic light/sign or control device 
  • Failure to obey stop sign
  • Failure to follow instruction of police officer
  • Failure to observe safety zone
  • Hazardous driving/careless driving
  • Passing violations
  • Littering

2 Points:

  • Improper turn/backing/start/stop
  • Impeding traffic
  • Improper entering/exiting trafficway
  • All varieties of improper lights
  • Following too closely
  • Improper signal/failure to signal
  • More than three passengers in front seat
  • Speeding 5 to 9 m.p.h. above posted limit
  • All varieties of failure to possess/display a valid driver’s license and/or the proper endorsements
  • Certain offenses of driving while suspended
  • Joyriding 
If a driver accumulates 12 or more points their license will be suspended. Point totals and suspension durations are listed as follows:

  • 12-13 points = 30 Days
  • 14-15 points = 45 Days
  • 16-17 points = 60 Days
  • 18-19 points = 90 Days
